An Act of the Scottish Parliament to make provision for the marriage of persons of the same sex; to make further provision as to the persons who may solemnise marriage and as to marriage procedure and the places at which civil marriages may be solemnised; to make provision for the registration of civil partnerships by celebrants of religious or belief bodies; to make provision about gender change by married persons and civil partners; to make a minor correction in relation to registration information; and for connected purposes.

This Act makes it legal for same sex couples in England and Wales to marry. The provisions in schedule 5 also allows people who are married to obtain a legal gender change as long as the spouse consents.

The Equality Act 2006 introduced the Gender Equality Duty, which places an obligation on public bodies to pay due regard to the need to address and eliminate the unlawful discrimination and harassment of transsexual people in employment, related fields and vocational training (including further and higher education) and in the provision of goods, facilities and services.

This Act of Parliament allows trans people to apply for a full Gender Recognition Certificate (GRC) which changes their legal gender and provides them with a new birth certificate. There are a number of restrictions and requirements on the issuing of a full GRC, including that the trans person by not married and not in a civil partnership. A married or civilly partnered person can only get an interim GRC which allows them to end their relationship and then obtain a full GRC.
